Early Case Assessment
Whether you call it Early Case Assessment (ECA) or Early Data Assessment (EDA), industry experts recognize that an early evaluation analysis of collected ESI can significantly reduce discovery and other associated litigation cost by providing a quick peek into your case data prior to full data processing and document review. This will assist with preparing for Meet and Confer and preparing an estimated budget for discovery and document review.
The objective of this phase in the discovery process is to reduce the volume of potentially responsive documents that needs to be reviewed. The easiest way to reduce the volume of data to be processed and reviewed is to start with a defensible targeted data collection based on specific parameters such as date range, custodian and retention policy that is agreed by parties involved.
D1 Legal ECA includes the following services:
- Objective/Subjective Data Culling
- Search Terms Report
- Foreign Language Detection
- De-duplication
- De-NIST
- Data Analysis
- Filtering
- Metadata Extraction
- Date
- Domain Filter

E-Discovery Processing
Once your data has been collected and you have performed and ECA review, it is time to begin the processing and conversion to a usable format for attorney responsive and privilege review. The Project Manager will be responsible to plan, execute and monitor and control the processing phase. A project workflow map will be created and maintained throughout the data processing lifecycle. The original document integrity will be preserved as it existed in the normal course of business.
The main objective is to reduce the volume of data and prepare the ESI documents for efficient review and production to other parties.
Below are additional action objectives during this processing phase:
- Meeting with the legal team and stakeholders to discuss their processing, review requirements and creation of technical specifications
- Search and Filter Terms
- Monitor Performance
- Reporting of quality control exceptions

Technology Assisted Review (TAR)
TAR is sometimes referred to as “Predictive Coding,” “Computer Assisted Review (CAR),” or “Machine Learning.” TAR is a document review process/methodology that uses math based algorithms and linguistics to quickly and efficiently categorizes large sets of documents based on their conceptual content.
Eclipse TAR analyzes and categorizes documents to make the document review process more efficient and cost-effective.
Eclipse’s analytics engine prioritizes documents based on relevance through small sample sets. Verify the sample set, and then Eclipse sort the population into categories, leaving irrelevant documents uncategorized. This innovative document categorization technology allows law firms and organizations to achieve better reviews faster.
